Abstract
En el presente trabajo de investigación, se analizará dos aspectos procesales dentro del Derecho Penal, el primero es el desarrollo y límites del allanamiento a cargos, en las diferentes etapas del proceso penal, el cual debe cumplir unas características como son; que debe ser un acto voluntario, unilateral, debidamente informado y asesorado por la defensa y que no vulnere garantías fundamentales, obteniéndose a cambio un beneficio que se ve reflejado en el quantum punitivo; esta manifestación debe ser aprobada por un Juez Penal Municipal de control de garantías, o según sea el caso el Juez de Conocimiento.
El segundo aspecto Procesal, es examinar que “el allanamiento a cargos es una institución jurídica diferente a las distintas modalidades y limitaciones de los preacuerdos como acto bilateral consensuado, consagrados en la ley 906 de 2004”. En este sentido la Sala de Casación Penal de la Corte Suprema de Justicia, en sentencia SP-14496 de septiembre 27 de 2017 se pronuncia manifestando que en los operadores judiciales existe confusión al aplicar los dos preceptos que son totalmente diferentes, por ello decidió reexaminar el tema del allanamiento, que éste por sí solo no conlleva a un preacuerdo y menos aún principio de oportunidad.
In this research work, two procedural aspects within the criminal law will be analyzed, the first being the development and limits of the search of the offices, in the different stages of the penal process, which must fulfil some characteristics as they are; That it must be a voluntary act, unilateral, duly informed and advised by the defence and that it does not violates fundamental guarantees, obtaining in return a benefit that is reflected in the punitive quantum; This manifestation must be approved by a Municipal Penal judge for the control of guarantees, or as the case may be the knowledge judge.
The second procedural aspect, is to examine that "the trespassing is a legal institution different from the different modalities and limitations of the preagreements as a consensual bilateral act, enshrined in law 906 of 2004". In this sense, the criminal Cassation Chamber of the Supreme Court of Justice, in judgement SP-14496 of September 27 of 2017, declares that in the judicial operators there is confusion when applying the two precepts that are totally different, therefore It decided to re-examine the subject of the raid, that this alone does not lead to a preagreement and even less principle of opportunity.
