Resumen
El derecho a la protección de datos ha trascendido en el amparo de las garantías y libertades consagradas en la Constitución Política de Colombia, en concreto, los derechos a la intimidad y a la información; así las cosas y gracias al avance de la tecnología y la sistematización de los datos, la protección y la guarda de los datos son amparados por el ordenamiento jurídico; esta situación se ve reflejada con posterioridad en el desarrollo del derecho del Habeas Data y su aplicación en la historia clínica, pero la circulación restringida de su información no se cumple en algunas situaciones, dejando claro que la atención en salud no es solamente el derecho a garantizar el equilibrio físico y mental de los pacientes sino garantizar los derechos derivados de esa atención médica, oportuna, donde se encuentre la protección de sus datos y el acceso legal a ellos para los informes de historias clínicas y medios de obtener el consentimiento informado de los pacientes.
The right to data protection has transcended in the protection of the guarantees and freedoms enshrined in the Political Constitution of Colombia, specifically, the rights to privacy and information; this way things and thanks to the advance of the technology and the systematization of the data, the protection and the saving of the data are protected by the legal ordering; This situation is later reflected in the development of the right of habeas data and its application in the medical history, but the restricted circulation of your information is not met in some situations, making it clear that health care is not only the right to guarantee the physical and mental balance of the patients but guarantee the rights derived from that medical attention, timely, where the protection of their data is found and the legal access to them for the reports of medical records and means of obtaining the informed consent of the patients.
