Abstract
La migración ilegal es un acontecimiento que influye directamente en la política pública, dado que eleva cuantitativamente los índices de criminalidad, inseguridad, insalubridad y desempleo. Los inmigrantes ilegales representan paradójicamente dos condiciones antagónicas, por un lado, pueden ser víctimas de un acontecimiento político, bélico, económico, étnico, social y natural (Terremoto, inundación o condición climática extrema) y por el otro lado, se convierten en objetivos del derecho penal del enemigo, dada la trasgresión palmaria a las leyes migratorias del Estado. De acuerdo a la amenaza representativa para la seguridad, el presente trabajo de investigación, pretende acercar al lector a través del camino de las políticas del acontecimiento, exponiendo en tres escenarios diferenciados el desafio que representa este fenómeno para la política pública del Estado colombiano y en concreto para la política criminal.
Illegal migration is an event that directly influences public policy, since it quantitatively raises crime, insecurity, unhealthiness and unemployment rates. Illegal immigrants paradoxically represent two antagonistic conditions, on the one hand, they may be victims of a political, war, economic, ethnic, social and natural event (earthquake, flood or extreme weather condition) and on the other hand, they become targets of criminal law of the enemy, given the palmar transgression to the immigration laws of the State. According to the representative threat to security, the present research work, aims to bring the reader through the path of the event's policies, exposing in three different scenarios the challenge that this phenomenon represents for the public policy of the Colombian State and in concrete for criminal policy.
