Abstract
En el presente trabajo de investigación se identificó que la negación de aplicar a favor de la madre o padre de cabeza de familia de la institución jurídica de la detención domiciliaria en la jurisdicción penal militar, a razón de la ausencia de esta medida sustitutiva en el digesto punitivo castrense (leyes 522, 1999 y 1407, 2010), puede en su caso vulnerar derechos fundamentales de interés superior como los derechos de los niños y el derecho de la familia, es por ello que desde el ámbito o teoría del Test de Proporcionalidad del maestro Robert Alexis -ley de precedencia condicional-, y sus respectivos sub principios (la idoneidad, necesidad y proporcionalidad) se logró sopesar los interés que se encontraban en juego, y se determinó que debía privilegiarse el interés superior del menor y concederse esta medida sustitutiva de la detención preventiva, por encima de la libertad de configuración legislativa y la especialidad del derecho militar.
In this research work, it was focused on the fact that the denial that exists to apply in favor of the mother or father of the head of the family of the legal institution of home detention in the military criminal jurisdiction, due to the absence of this substitute measure In the military punitive digest (laws 522, 1999 and 1407, 2010), it may violate fundamental rights of superior interest such as the rights of children and the right of the family, that is why from the scope or theory of the Test of Proportionality of the teacher Robert Alexis -conditional precedence law-, and their respective sub-principles (suitability, necessity and proportionality) it was possible to weigh the interests that were at stake, and it was determined that the best interests of the minor should be privileged and granted this substitute measure for preventive detention, above the freedom of legislative configuration and the specialty of military law.
