Resumen
La Unidad para la Atención y Reparación Integral a las Víctimas, expidió la resolución 2015-156962 que reconoce en nombre del Estado colombiano la condición de víctima colectiva a la Universidad del Atlántico, debido a la vulneración del derecho constitucional a la autonomía universitaria (p. 6) y por los hechos violentos acontecidos entre 1997 y 2009 (Corena et al, 2017) con los que se vulneraron múltiples derechos a los miembros a la Comunidad Académica de la Institución. En consecuencia, se conformó el Comité de Impulso para la Reparación Colectiva, órgano con representación multiestamentaria con el cual se concierta y gestiona el proceso de reparación. A la fecha se han adelantado acciones de promoción y prevención orientadas a la garantía de no repetición y se encuentra en elaboración el diagnóstico del daño y el Plan Integral de Reparación Colectiva – PIRC. El presente trabajo consiste en identificar eventuales escenarios, producto de la negociación en la construcción del PIRC, dada la multiplicidad y diversidad de intereses en torno a las acciones y beneficiarios potenciales de los procesos de reparación material y de las restricciones en cuanto a recursos. Para ello, se siguió una metodología de investigación mixta, a través de la cual se identificaron actores, sus posiciones y factores de análisis, luego éstos se procesaron con la ayuda de herramientas cuantitativas, para modelar escenarios. Los escenarios resultantes conjugan la mayor probabilidad de ocurrencia de las hipótesis y/o eventos constituidos a partir de los factores relevantes y estructurales del análisis. El mayor impacto del trabajo está en su capacidad para orientar la discusión hacia la construcción de un PIRC viable y efectivo, frente a lo cual se encontró que las perspectivas del proceso de reparación colectiva de la Universidad del Atlántico, reflejan el panorama de incertidumbre y polarización que se vive en el País y en la misma Institución, eventualmente por temas asociados a su gobernabilidad, requisito sine qua non para que avance positivo en el proceso.
The Unit for the Victims Assistance and Reparation, issued resolution 2015-156962 that recognizes in behalf of the Colombian State the condition of collective victim to the Universidad del Atlántico, due to the violation of the constitutional right to university autonomy (p. 6) and the violent events that occurred between 1997 and 2009 (Corena et al, 2017) in which multiple rights were violated on members of the Academic Community in the Institution. As a result, the Impulse Committee for Collective Reparation was created, with which is agreed and managed the reparation process. Currently, promotion and prevention actions aimed at guaranteeing non-repetition have been carried out; the diagnosis of the damage and the Comprehensive Collective Reparation Plan - CCRP are in the process of being elaborated. The present work consists of identifying scenarios, product of the negotiation in the construction of the CCRP, given the multiplicity and diversity of interests around the actions and potential beneficiaries of the material reparation processes and the restrictions on resources. For this, a mixed research methodology was followed, through which actors, their positions and analysis factors were identified, then they were processed with the help of quantitative tools, to model scenarios. The resulting scenarios combine the highest probability of occurrence of the hypotheses and/or events constituted from relevant and structural factors of the analysis. The greatest impact of the work is its ability to guide the discussion towards the construction of a viable and effective CCRP, against which it was found that the perspectives of the collective reparation process of the Universidad del Atlántico, reflect uncertainty and polarization that is lived in the Country and in the same Institution, possibly due to issues associated with its governance, sine qua non requirement for positive progress in the process.
