Abstract
El problema jurídico de investigación se funda, en identificar si el acceso a la administración de justicia por parte de la víctima en la jurisdicción castrense es efectivo (Ley 522 de 1999) en relación a las funciones del Fiscal en la etapa de calificación y acusación. Es por ello, que es válido preguntarse ¿Cuáles son las implicaciones del ejercicio de la acción civil para que las víctimas accedan a la justicia militar en la etapa de calificación y acusación?, teniendo como dimensión jurídica la validez. Para lograr hallar la respuesta a la pregunta antes planteada, se hizo necesario realizar un estudio de la acción civil, la víctima, el acceso a la justicia y la interpretación constitucional y convencional del derecho penal militar.
The legal research problem is based on identifying whether access to the victim’s administration of justice in military jurisdiction is effective (Law 522 of 1999) in relation to the duties of the Prosecutor at the qualification and indictment stage. That is why it is valid to ask: What are the implications of the exercise of civil action for victims to access military justice at the qualification and prosecution stage? Having as a legal dimension the validity. In order to find the answer to the question posed above, it became necessary to carry out a study of civil action, the victim, the access to justice and the constitutional and conventional interpretation of military criminal law.
