Abstract
La Corte Constitucional con la sentencia SU-09d5 de 2018 se aparta del precedente jurisprudencial que permitía a las entidades territoriales acudir a las consultas populares sobre minería y, por tanto, ignora el reconocimiento a la autonomía territorial para consultar directamente a la población sobre tal asunto. Por lo que con la sentencia mencionada, la Corte desconoce derechos constitucionales como la vida, la salud, el medioambiente sano, en pocas palabras: desconoces los derechos humanos de la población a autodeterminarse y participar directamente en asuntos que afectan su vida comunitaria; en pocas palabras, desconoce fundamentos del estado social de derecho colombiano como la justicia, la soberanía popular y la democracia participativa.
The mining activity in the Colombian territory has promode a debate between unatity state, territorial autonomy and popular participation on the subject. The Constitutional Court with the SU-095 of 2018 sentence has departed from the jurisprudencial precedent that allowed the popular consultation to the population on the subject. Therefor, with the mentioned sentence, the Court ignore constitutional rights such as life, health, food security, healthy environment, shortly: ignores population’s human rights who has been arbitrarily expoused to mining activity; as well as, it ignores, the social rule of law’s state fundamentals such as popular soberegnity and participate democracy.
