Abstract
Con el presente trabajo se estudia la institución procesal de la cosa juzgada fraudulenta, criterio empleado por los tribunales colegiados internos e internacionales para derrumbar un proceso penal utilizando para tal finalidad el argumento de falta de competencia, imparcialidad e independencia cuando ha sido investigado y fallado por la justicia penal militar colombiana. Se buscó evidenciar la afectación que genera este tipo de decisiones para un militar o policía sometido a un proceso judicial de naturaleza punitiva por varios años y luego de una decisión absolutoria debe sortear una carga adicional representada por una nueva causa penal, esta vez, en otro tribunal, bajo otro procedimiento y con distintos estándares de prueba.
With this work, the institution of prosecution of the thing judged fraudulent is studied, the criterion used by the internal and international collegiate courts to collapse a criminal proceeding using for this purpose the argument of lack of competence, impartiality and independence when investigated and failed by colombian military criminal justice. t was sought to show the affectation that this type of decision generates for a military or police subjected to a judicial process of a punitive nature for several years and after an acquittal decision it must avoid an additional charge represented by a new criminal case, this time, in another court, under another procedure and with different test standards.
