Abstract
El presente artículo de investigación, analiza el marco jurídico, y la pertinencia de la agregación del personal militar establecida en el artículo 109 de la ley 1862 de 2017 “Por la cual se establecen las normas de conducta del Militar Colombiano y se expide el Código Disciplinario Militar”, frente al principio de especialidad normativa, realizando una comparación con el régimen especial de carrera de oficiales y suboficiales, identificando los vacíos normativos, la falta de reglamentación y efectos jurídicos que se genera en contra de los miembros activos de las Fuerzas Militares y la legitimidad institucional; estableciendo su eficacia, a fin de evitar situaciones jurídicas adversas en contra de la institución, del personal militar y la afectación al núcleo familiar, que goza de especial protección en un Estado social de derecho.
This research article analyzes the legal framework, and the relevance of the aggregation of military personnel established in article 109 of Law 1862 of 2017 "By which the rules of conduct of the Colombian Military are established and the Disciplinary Code is issued Military ”, against the principle of normative specialty, making a comparison with the special career regime of officers and non-commissioned officers, identifying the regulatory gaps, the lack of regulation and legal effects that are generated against the active members of the Military Forces institutional legitimacy; establishing its effectiveness, in order to avoid adverse legal situations against the institution, the military personnel and the affectation of the family nucleus, which enjoys special protection in a social state of law.
