Abstract
La consulta previa es el derecho humano de las comunidades ancestrales a ser escuchadas antes de que se tome cualquier decisión que pueda afectarlas, y tiene como fin, garantizar su participación en la realización de todo proyecto que impacte en su territorio o su cosmovisión. Colombia ha tratado de adecuar su ordenamiento jurídico a los estándares internacionales a través de normas y de la jurisprudencia del alto tribunal constitucional. De allí que, normas como el Decreto 1320 de 1998, que regula el procedimiento de consulta en lo que respecta a la explotación de recursos naturales, se ha convertido en la causa de consultas irregulares o incompletas. Por tanto, este artículo analiza las decisiones judiciales de la Corte Interamericana de Derechos Humanos y la Corte Constitucional colombiana en la materia, con el propósito de verificar el funcionamiento de la consulta previa.
Prior consultation is the human right of ancestral communities to be heard before any decision that may affect them is made, and its purpose is to guarantee their participation in the realization of any project that impacts their territory or their worldview. Colombia has tried to adapt its legal system to international standards through norms and the jurisprudence of the high constitutional court. Hence, regulations such as Decree 1320 of 1998, which regulate the consultation procedure with regard to the exploitation of natural resources, have become the cause of irregular or incomplete consultations. Therefore, this article analyzes the judicial decisions of the Inter-American Court of Human Rights and the Colombian Constitutional Court on the matter, in order to verify the operation of the prior consultation.
