Abstract
El presente documento busca realizar un análisis de los limites jurídicos del Ejército Nacional de Colombia en el proceso de retorno o reubicación a las víctimas el conflicto armado, de acuerdo al marco normativo del proceso de restitución de tierras, los principios y los estándares internacionales , posteriormente Identificando cual es la participación del Ejército Nacional en el proceso de restitución de tierras conforme a lo establecido en la Ley 1448 de 2011 y sus Decretos Reglamentarios y finalmente comprendiendo las dificultades del Ejercito Nacional para ejercer su rol en el proceso de restitución de tierras. La investigación es de tipo teórico con un enfoque cualitativo. Como conclusiones se observa que existen unos límites impuestos al Ejercito Nacional ya que este simplemente facilita los instrumentos necesarios para la entrega del informe obtenido del estudio de seguridad (trabajo de campo) en donde la decisión de establecer si microfocaliza el terreno es competencia exclusiva del Director de la Unidad de Restitución de Tierras y que para poder el ejército acudir a dicho terreno requiere autorización o permiso de las demás entidades que intervienen en dichos procesos. Tal cual sucede con la limitación que tienen el Ejército Nacional momento de hacer el acompañamiento al momento de restituir materialmente el predio después de obtener sentencia, puesto que en algunas ocasiones esta no cuenta con las condiciones para ejecutar dicha función haciendo que el proceso sea más demorado, por la falta de apoyo institucional por parte de la rama ejecutiva.
This document seeks to carry out an analysis of the legal limits of the National Army in the process of return or relocation of the victims of the armed conflict, first of all defining the normative framework of the land restitution process, including International Humanitarian Law (IHL), subsequently Identifying which is the participation of the National Army in the land restitution process according to Law 1448 of 2011 and finally understanding the difficulties of the National Army to exercise its role in the land restitution process. The research is descriptive with a qualitative approach. As conclusions, it is observed that there are limits imposed on the national army because it simply provides the necessary instruments for the delivery of the report obtained from the security study (field work) where the decision to establish whether to microfocalize the terrain is exclusive competence of the director of the Land Restitution Unit and that in order for the army to go to said land, it requires authorization or permission from the other entities that intervene in said processes. As is the case with the limitation that the public forces have at the time of conducting the monitoring at the time of materially restoring the property after obtaining a sentence, since on some occasions it does not have the conditions to perform this function, making the process more delayed, due to the lack of institutional support from the executive branch
