Abstract
El personal militares que han sido retirados del servicio activo, por la causal de la disminución de la capacidad psicofísica laboral, por lesiones obtenidas en actividades militares o del servicio activo, que los jueces en sus decisiones judiciales, ordenan a las Fuerzas Militares el reintegro y reubicación laboral de estos funcionarios, en el mismo cargo, o en uno similar que pueda desem-peñar, desconociendo de primera mano la función pública que desempeñan los militares, que es, la defensa de la soberanía y seguridad de la nación, actividad para la cual el funcionario debe tener una capacidad psicofísica y psicológica de un 100%, de su buen estado de salud para poder desarrollar esta categórica función; con estas decisiones se le están poniendo unas cargas admi-nistrativas de personal, lo que genera pérdida de maniobra de las Fuerzas Militares de sus opera-ciones militares, debido a que los militares lesionados no pueden desarrollar esta actividad por su condición de discapacidad, lo que hace necesario ser reubicado laboralmente en otras labores y otras entidades del Estado con el fin de garantizar sus derechos.
The people military that have been retired of the active service, by the causal of the diminution of the psychophysical work capacity, for injuries obtained in military or service activities and that the judges in their judicial decisions order the military forces to relocate these functionaries in the same position in a similar one they can perform, ignoring first hand, the public function that per-formed by the military, as it is the defense and security of the nation, and danger due to military operations and that is why they must have a psychophysical capacity of 100%, in order to devel-op these activities, with these decisions they are putting an administrative burden of personnel, which generates loss of maneuver of the military forces in their military operations because the injured military can´t develop this activity, which makes necessary the relocation to work in other jobs and other entities of the state in order to guarantee their rights.
