Abstract
Con los hechos ocurridos en 1997 en Mapiripán, Meta, se abordaron elementos históricos del conflicto armado colombiano, de carácter no convencional; situación que permitió explicar si el derecho colombiano y el Derecho Internacional de los Conflictos Armados (DICA) se convirtieron en limitantes en el accionar de las Fuerzas Militares; para esto, se recurrió al estudio de caso, con un alcance exploratorio y correlacional para lo cual se utilizó la revisión documental y desde el análisis hermenéutico se encontró que fue desestimado por parte de la Corte Interamericana de Derechos Humanos el material probatorio, situación que produjo la condena del Estado colombiano por el caso y se abrió un debate sobre la legitimidad de las decisiones de la Corte, como ente de arbitraje, y de las sentencias que instan la aplicación de los derechos mencionados a las Fuerzas Militares (FFMM) de Colombia, al ser afectadas por un suceso difícilmente prevenible; porque se presentaron falsas víctimas procesadas y condenadas.
With the events that occurred in 1997 in Mapiripán, Meta, historical elements of the Colombian armed conflict of a non-conventional nature were addressed; a situation that made it possible to explain whether Colombian law and the International Law of Armed Conflict (ILAC) became limiting factors in the actions of the Armed Forces; For this, we resorted to the case study, with an exploratory and correlational scope for which we used the documentary review and from the hermeneutic analysis it was found that the evidentiary material was dismissed by the Inter-American Court of Human Rights, This situation led to the condemnation of the Colombian State for the case and opened a debate on the legitimacy of the decisions of the Court, as an arbitration body, and of the sentences that urge the application of the mentioned rights to the Colombian Military Forces (FFMM), as they were affected by an event that is difficult to revenge; because false victims were prosecuted and convicted.
