Abstract
Mediante este ensayo se pretende abordar la eficacia en la aplicación de una de las medidas comprendidas dentro del marco regulador de la contratación estatal en Colombia. El tipo de norma sobre la que se quiere medir su eficacia doctrinalmente ha sido denominada acción afirmativa. En el desarrollo de este ensayo se hace un breve recorrido por la definición, origen, elementos y tipos de acciones afirmativas y como los posibles beneficiarios de la medida, para el caso de estudio las PYMES, juegan un importante rol en la economía nacional, pero al mismo tiempo se encuentran en desigualdad frente a otros agentes económicos, lo que justifica el uso de esta herramienta con el objetivo de reducir la desigualdad.
Through this essay it is intended to address the effectiveness in the application of one of the measures included within the regulatory framework of state contracting in Colombia. The type of norm on which its effectiveness is to be measured has doctrinally been called “affirmative action”. In the development of this essay, a brief description about of the definition, origin, elements and types of affirmative actions and how the possible beneficiaries of the measure, for the case study, MSMEs, play an important role in the national economy, but at the same time they are in unequal situation compared to other economic agents, which justifies the use of this tool with the aim of reducing inequality.
