Resumen
Producto de las circunstancias socioeconómicas, Colombia es el país de América Latina donde
más gente vive en arriendo, bajo este escenario surgen diferencias entre arrendadores y
arrendatarios, el presente estudio establece el marco normativo del contrato de arrendamiento,
la conciliación y las acciones que tiene el arrendador para recuperar el inmueble dado en
arrendamiento, por lo que se busca determinar si la aplicación del Decreto ley 1818 de 1998 en
su artículo 5 una vez incumplido el acuerdo conciliatorio y el proceso de restitución de bien
inmueble arrendado afectan los derechos patrimoniales del arrendador.
El enfoque del presente ensayo resulta ser de tipo crítico y propositivo, frente a la efectividad
del Decreto ley 1818 de 1998, y determinar la vulneración de los derechos patrimoniales del
arrendador proyectando un cambio al artículo 5 del Decreto ley 1818 de 1998, que equilibrela
relación contractual entre arrendador y arrendatario.
Concluyendo que el Decreto ley 1818 de 1998, en su artículo 5 resultan en la vulneración de
los derechos patrimoniales del arrendador, al ser un proceso con condiciones indeterminadas,
empeorando la situación del arrendador quien busca la restitución del bien inmueble objeto del
contrato de arrendamiento y el pago de los cánones de arrendamiento adeudados, por lo que se
propone una modificación del artículo 5 del Decreto ley anteriormente citado
As a result of socioeconomic circumstances, Colombia is the country in Latin America where
more people live in rent, under this scenario differences arise between landlords and
tenants, this study establishes the regulatory framework of the lease,
the conciliation and the actions that the lessor has to recover the property given in
lease, so it seeks to determine if the application of Decree Law 1818 of 1998 in
its article 5 once the conciliatory agreement and the process of restitution of property have been breached
leased property affect the patrimonial rights of the lessor.
The focus of this essay turns out to be critical and purposeful, compared to the effectiveness
of Decree Law 1818 of 1998, and determine the violation of the patrimonial rights of the
landlord projecting a change to article 5 of Decree Law 1818 of 1998, which balances
contractual relationship between lessor and lessee.
Concluding that Decree Law 1818 of 1998, in its article 5 result in the violation of
the patrimonial rights of the lessor, as it is a process with undetermined conditions,
worsening the situation of the lessor who seeks the restitution of the real estate object of the
lease agreement and the payment of the lease fees owed, for which
proposes a modification of article 5 of the aforementioned Decree Law
