Abstract
El principio de oportunidad faculta al ente investigador para suspender, interrumpir o desistir del ejercicio obligatorio de la acción penal; de allí que, el ordenamiento penal interno, en la Ley 906 de 2004, prevé una serie de causales que le otorgan a la Fiscalía General de la Nación la posibilidad de determinar en qué eventos procede la aplicación de esta figura. No obstante, puede entreverse que los límites pueden convertirse en un obstáculo para su aplicación, cuando la persecución penal se desarrolla sobre la ocurrencia de delitos de lesa humanidad o infracciones al Derecho Internacional Humanitario. Así las cosas, luego de mencionar los controles existentes, se describen los tratamientos penales especiales otorgados a miembros de la Fuerza Pública una vez finalizado el conflicto armado, desde lo que se quiere determinar si la normatividad implementada a partir del Acuerdo Final respeta los límites establecidos para utilizar la institución jurídica estudiada.
The principle of opportunity empowers the investigating entity to suspend, interrupt or desist from the compulsory exercise of criminal action; Hence, the domestic criminal law, in Law 906 of 2004, provides a series of grounds that give the Office of the Attorney General of the Nation the possibility of determining in which events the application of this figure proceeds. However, it can be seen that the limits can become an obstacle to their application, when the criminal prosecution is carried out on the occurrence of crimes against humanity or infractions of International Humanitarian Law. Thus, after mentioning the existing controls, the special criminal treatments granted to members of the Public Force on the occasion of the end of the armed conflict are described, from which it is sought to determine whether the regulations implemented from the Final Agreement whether or not it respects the limits in the application of the legal institution studied.
