Resumen
La fuerza pública colombiana en cumplimiento de su deber por mandato constitucional a preservar la independencia, la soberanía, la integralidad territorial, el orden constitucional, y la salvaguarda del orden público en determinadas circunstancias cometen delitos estando en servicio activo al momento de ejecutar estas obligaciones, al actuar en nombre de la Constitución merecen por dicha actividad ser juzgados por Cortes Marciales o Tribunales Militares siempre y cuando las conductas cometidas no atenten contra el Derecho Internacional Humanitario y el Derecho Internacional de los Derecho Humanos, en las demás situaciones merecen un juez natural que administre justica para ellos, este debe tener determinas características para cumplir con los parámetros internacionales del debido proceso; para lo cual dividiremos esta investigación en tres ejes temáticos, comenzando por i) la conceptualización del juez natural, posteriormente ii) determinaremos el contenido teórico de la jurisdicción penal militar específicamente sobre los funcionarios que integran las cortes marciales y los tribunales militares, para concluir iii) con el establecimiento del cumplimiento por parte de los funcionarios que integran las cortes marciales y los tribunales militares y las condiciones propias del juez natural.
