Abstract
El presente artículo de reflexión pretende analizar el fuero militar en Colombia en relación con los pronunciamientos tanto de la Corte Constitucional colombiana, como de la Corte Interamericana de Derechos Humanos. En efecto, luego de examinar el Acto Legislativo 02 de 2012, “por el cual se reforman los artículos 116, 152 y 221 de la Constitución Política de Colombia”, donde la Corte (constitucional) decidió declarar inexequible la norma, lo cual representa para los miembros de la Fuerza Pública la continua vulneración a las garantías judiciales y protección judicial, premisa a la que se llega a través de la lectura y evaluación jurídico-política de los pronunciamientos de la Corte Constitucional y el sistema interamericano de protección de los Derechos Humanos, más aún cuando Colombia en la actualidad se enfrenta a un proceso de paz que genera toda clase de incertidumbres sobre el futuro judicial de los miembros de la Fuerza Pública, presupuesto que se establece luego del análisis elaborado a través de los 4 capítulos por los cuales está compuesto el presente artículo que estudia de la misión constitucional de los soldados de la patria, sus garantías judiciales y las implicaciones del fuero penal militar en lo que respecta a la actualidad nacional.
This article analyzes the reflection military courts in Colombia in connection with the statements of both Colombian Constitutional Court, and the Inter-American Court of Human Rights. Indeed, after examining the Legislative Act 02 of 2012, "by which Articles 116, 152 and 221 of the Constitution of Colombia are reformed" where the Court (constitutional) decided to declare unconstitutional the norm, accounting for members of the security forces continued violation of judicial guarantees and judicial protection, premise which is reached through reading and legal-political assessment of the rulings of the Constitutional Court and the Inter-American System for the Protection of Human Rights , especially when Colombia now faces a peace process that generates all kinds of uncertainties about the legal future of members of the security forces, budget analysis is then set developed through the 4 chapters which It is composed this article studying the constitutional mission of the soldiers of the homeland, its judicial guarantees and the implications of military criminal jurisdiction with regard to national news.
