Resumen
La Justicia Penal Militar se desarrolla en el marco especifico de las condiciones particulares en las que se llevan a cabo las labores de la Fuerza Pública, lo que requiere de un sistema que entienda las vicisitudes de esta labor y pueda ejercer justicia con imparcialidad, respetando el debido proceso y teniendo en cuenta los atenuantes que el caso pueda tener.
El rol de poder jurisdiccional específico que se otorga a la Justicia Penal Militar, sugiere la adecuación de disposiciones y normas con el ánimo de garantizar un abordaje coherente con las particularidades implícitas en los delitos cometidos por miembros de la fuerza pública. Ejemplo de ello es el objetivo principal del análisis desarrollado en este artículo, consistente en indagar sobre la exclusión del principio de oportunidad en el Código Penal Militar, pese a estar tipificado en el Código de Procedimiento Penal.
Las circunstancias por las cuales se produce esta exclusión se sustentan tanto en la esencia misma del derecho como en la misma legislación colombiana y la configuración de la Justicia Penal Militar y las razones por las cuales se estableció el fuero penal.
The military justice is developed in the specific context of the particular conditions under which conducted the work of law enforcement, which requires a system that understands the vicissitudes of this work and to exercise justice with impartiality, respecting the due process and taking into account the mitigating that the case may have.
The role of specific judicial power given to the military justice suggests the adequacy of provisions and regulations with the aim to ensure a consistent approach to the implicit characteristics of the offenses committed by members of the security forces. An example of this is the main objective of the analysis developed in this paper, consisting investigate the exclusion of the principle of opportunity in the Military Criminal Code, despite being defined in the Code of Criminal Procedure.
The circumstances under which this exclusion occurs are based on both the essence of the right and in the same Colombian legislation and the configuration of the Military Criminal Justice and the reasons why the criminal court was established.
