Abstract
El gobierno nacional establece que el servicio militar se podrá prestar como Auxiliar de Policía Bachiller, Al estar incorporados dentro de las fuerzas militares o policiales los jóvenes adquieren un rol diferente al joven civil, y con este rol también ciertas responsabilidades que al no ser cumplidas, conllevan a consecuencias que solo pueden ser entendidas dentro de este contexto. Las fuerzas armadas colombianas, se encuentra dentro de varias circunstancias especiales, entre ellas las posibles conductas delictuosas cometidas por sus miembros. Dentro de estos delitos al servicio se encuentra el delito de Deserción, el cual está regulado y tipificado por el Art. 109, ley 1407 de 2010 y hace referencia a cuando quien presta servicio militar Se ausente sin permiso por más de cinco (5) días consecutivos del lugar donde preste su servicio, entre otras consideraciones. Al ser una conducta que solo las fuerzas militares y de policía los tribunales civiles no investigan y dictan sentencias sobre estos delitos. A lo largo de la historia de la deserción se han visto un sin número de causantes para que el soldado abandone las filas. En la actualidad, se pueden reunir las situaciones que conllevan a que quienes se encuentren prestando el servicio militar obligatorio, abandone y no decida culminarlo, en situaciones sociales, familiares, personales, entre otras. Y que estas razones puedan variar entre las fuerzas militares y policiales ya que poseen características y funciones diferentes; haciendo necesario estudiar los factores que conllevan a que la conducta de deserción. En este estudio se pretende identificar las diferentes causales por las cuales el Policía Bachiller, durante la prestación del servicio militar obligatorio, incurre en el delito de deserción; para ello se estudiaron las conductas de deserción investigadas por el juzgado 143 de instrucción penal militar durante los años 2007, 2008, 2009, 2010, 2011, 2012, 2013, 2014 y 2015. A partir de los resultados encontrados podemos marcar primero, un alto número de casos en donde no se conocen las causas por las cuales el acusado cometió el delito, segundo, un alto porcentaje de casos donde la razón reportada es un estado de necesidad frente a condiciones de salud.

This study aims to identify the different grounds on which the auxiliary police, during compulsory military service, commits the offense of desertion; for it dropout behaviors investigated by the military criminal court 143 instruction during the years 2007, 2008, 2009, 2010, 2011, 2012, 2013, 2014 and 2015. From the results we can score first studied, a high number of cases where the reasons for which the defendant committed the crime, second, a high percentage of cases reported where the reason is a necessity against health conditions are not known
