Abstract
Colombia adopta y reconoce la Declaración Universal de Derechos Humanos, ha sido miembro pleno de la Organización de las Naciones Unidas y participó en la elaboración de la misma, a partir de 1991 con la Nueva Constitución se reconoce como un Estado Social de Derecho en tal sentido por vía judicial los seres humanos homosexuales han logrado en los últimos veinticinco años, el reconocimiento de casi todos sus derechos, menos el del derecho al matrimonio. En una interpretación política y de relaciones internacionales amplia, no jurídica, del artículo 16 de la DUDH, Colombia debería reconocer este derecho.
