Resumen
El Derecho Internacional Humanitario hace parte del derecho internacional público y se centra en la protección de la persona frente a conflictos de carácter no internacional, cuyas fuentes son el artículo Tercero Común a los cuatro Convenios de Ginebra celebrados en el año 1949 y en el Protocolo II Adicional de 1979, que buscan esencialmente la protección de las víctimas y la conducción de hostilidades en el marco de conflicto no internacional.
El Derecho Disciplinario es una herramienta que apunta a la observancia permanente del DIH por parte de los servidores públicos que ostentan el uso de la fuerza y que ocupan el escenario de las hostilidades internas, ya que como modalidad de derecho sancionador busca la efectividad en el avance hacia la consecución de los fines previstos en el artículo 2° de la Magna, a través del ejercicio de las funciones públicas, entre las que cuenta, la observan de la Constitución y las normas como integran el Bloque de Constitucionalidad.
En el desarrollo de la actuación procesal disciplinaria, el ejercicio probatorio apunta a encontrar la verdad que a la vez permita garantizar la impartición de justicia relación con los hechos que dan origen a la actuación procesal y establecer los presupuestos para sancionar, identificar e individualizar a los responsables y sus víctimas.
International humanitarian law makes part of the international public law, and focuses in the protection of the person to deal with conflicts of non-international level, whose sources are third common Article to the four agreements of Geneva held in 1949, and the Additional Protocol II of 1979, which essentially seek the protection of the victims and the conduct of hostilities in the context of non-international conflict.
The Disciplinary Law is a tool which points to the permanent observance of DIH by public servants, which use force and take the stage of the internal hostilities, since as modality of punitive law seeks the effectiveness in the advance toward the consecution of the intended purposes in 2nd Article of the Magna, through the exercise of the public functions, among the ones it has, it is observed of the Constitution and the rules being part of the bloc of Constitutionality.
In the development of the procedural disciplinary action, evidence aims to find the truth, at a time that can ensure the administration of justice, relation to the facts that give rise to the procedural action, and establishing the budgets to penalize, identify and individualize those responsible and their victims.
