Resumen
Recientemente fue promulgada la Ley de Inteligencia que le otorga un marco jurídico a las funciones de inteligencia que cumplen las dependencias de las Fuerzas Militares y la Policía Nacional. Antes de la promulgación de la Ley Estatutaria 1621 de 2013, se intentó expedir otras normas que buscaban el mismo objetivo, sin embargo sufrieron reveses en su trámite, por lo que antes de esta ley fue la jurisprudencia a través de diversos fallos proferidos desde el año 1992, la que intentó fijar los alcances y límites de la función de inteligencia; esos criterios fueron recogidos en la Ley 1621 de 2013. La norma recogió los principios que la Jurisprudencia había enunciado como límites para el desarrollo de la función de inteligencia: respeto de los derechos humanos, protección del derecho a la honra, el buen nombre, la intimidad personal y familiar y el debido proceso e igualmente sus fines: la consecución de los fines esenciales del Estado, la protección de las instituciones democráticas y los derechos de los ciudadanos. Entre otras facultades la norma autoriza a los organismos que cumplen funciones de inteligencia acceder a bases de datos y monitorear el espectro electromagnético, pero ninguna de estas actividades contempla un control efectivo, solo establecen un autocontrol fundamentando en el estricto cumplimiento de los fines que se les ha encomendado. La Ley de Inteligencia tangencialmente aborda la interdependencia que podría llegar a existir entre la función de inteligencia y la actividad de investigación judicial, pero no desarrolla suficientemente el tema. La función de inteligencia al carecer de claras directrices normativas, en la práctica depende necesariamente de la función de investigación judicial en cabeza de los organismos de Policía Judicial.
Recently it Was enacted an Intelligence Law that gives a legal framework for intelligence functions that meet the dependencies of the Armed Forces and National Police. Before the enactment of the statutory law 1621 of 2013 , we attempted to issue further rules seeking the same goal , but suffered setbacks in the course , so that before this law was the working, through various rulings made since 1992 , which attempted to set the scope and limits of the intelligence function ; these criteria were included in the law of 1621/13 . The standard picked the principles that the rulings had stated as limits for the development of the Role of Intelligence: respect for human rights , protection of the right to honor , good name , personal and family privacy and due process, and also their purposes: the achievement of the essential goals of the state , protection of democratic institutions and the rights of citizens . Among other powers the rule authorizes agencies engaged in intelligence access to databases and monitoring the electromagnetic spectrum , none of these activities provide an effective control, only establish a self basing on strict compliance with the purposes for which they have entrusted . The intelligence law tangentially addresses the interdependence that could exist between the intelligence function and activity of Judicial investigation , but not enough develops the theme . The intelligence function to lack of clear policy guidelines in practice necessarily depends on the role of judicial Research head of the judicial police agencies .
