Resumen
La función pública se cumple a través de burocracias públicas, en el contexto de productividad y consecución de sus objetivos traducidos en el cumplimiento de los fines esenciales del Estado y satisfacción de las necesidades de la población, en este sentido, el Estado requiere la suficiencia estructural y profesional para la atención y adecuada prestación de los servicios a su cargo, siendo el sistema de mérito y la carrera administrativa el mecanismo por excelencia para atraer y retener al personal calificado para el servicio; de esta forma existen diversos medios para acceder u ocupar un cargo público, entre ellos la meritocracia, la elección popular y el libre nombramiento y remoción.
Indistintamente del mecanismo de acceso a la administración, los funcionarios deben cumplir cabalmente con las disposiciones contenidas en la constitución, las leyes, políticas públicas y reglamento, todas estas fuentes de la función pública, con el objetivo exclusivo de cumplir los fines estatales, bajo los parámetros de eficiencia y eficacia. En el ejercicio de sus funciones, el servidor tiene la facultad de delegar funciones a su subordinado a través de actos expresos, constituyéndose en posición de garante y convirtiéndose en potencial responsable disciplinario por la objetivación de la responsabilidad.
The civil service is met through public bureaucracies, in the context of productivity and achievement of its objectives translated in fulfilling the essential purposes of the State and meeting the needs of the population, in this regard, the State requires structural sufficiency and professional for care and adequate provision of services responsible, making the merit system and administrative career as a mechanism to attract and retain qualified personnel for service was implemented; thus there are then various means of public office, including meritocracy, elected and appointed and removed.
