Abstract
El presente artículo de investigación aborda, desde la perspectiva de la jurisprudencia y la doctrina nacional, el tema de la necesidad de contar con un testigo de acreditación para la introducción de los documentos públicos en el juicio oral propio del sistema penal acusatorio, atendidas las diversas interpretaciones que se le han venido dando en el país a las normas que regulan el tema y la práctica judicial. El cambio de sistema procesal penal en el país, originado en el acto legislativo 03 de 2002, implicó un cambio trascendental en el régimen probatorio y principalmente en lo que tiene que ver con la prueba documental, toda vez que, contrario a lo que acontecía en el régimen procesal de la Ley 600 de 2000, en el que operaba el principio de permanencia de la prueba, en el nuevo sistema acusatorio sólo se considera prueba la que se practica en sede del juicio oral, público y concentrado. Así entonces, se ha planteado que la introducción del documento público en el sistema acusatorio, que debe hacerse en el juicio para permitir su contradicción, sólo puede cumplirse a través del denominado testigo de acreditación, exigencia que puede considerarse incompatible con la presunción de autenticidad de este tipo de documentos frente a la aplicación del principio de mismidad, que en últimas ha sido el argumento en el que se soporta tal requerimiento procesal.
This research article discusses, from the perspective of national jurisprudence and doctrine, the issue of the need for a witness to the introduction of accreditation of public documents in the proper trial of the adversarial criminal justice system, attended the various interpretations that have been taking place in the country to the rules governing the issue and in judicial practice.
The changing criminal justice system in the country originated in the legislative act 03 of 2002, involved a major change in the rules of evidence and mainly it has to do with the documentary evidence, since, contrary to what happened in the procedural provisions of Law 600 of 2000, which operated the principle of consistent evidence in the new accusatory system only considered proof that practiced in oral headquarters, and concentrated public trial.
So then, it has been suggested that the introduction of a public document in the adversarial system, which must be made at trial to permit contradiction can only be met through the named token accreditation requirement may be considered incompatible with the presumption of authenticity against such application of the principle of sameness documents, which ultimately has been the argument that such a procedural requirement is supported.
