Abstract
La Ley de Víctimas y Restitución de Tierras es el conjunto de medidas necesarias para lograr los principios de la Justicia Transicional en Colombia, verdad, justicia y reparación para las víctimas con ocasión al conflicto armado. Para hablar de conflicto armado sin carácter internacional según el Protocolo II adicional a los Convenios de Ginebra de 1949” relativo a la protección de las víctimas de los conflictos armados sin carácter internacional de 1977”, deben existir enfrentamientos entre el Estado y actores armados disidentes siempre y cuando estos tengan i) mando responsable ii) control territorial suficiente para iii) realizar operaciones militares y iv) aplicar las normas humanitarias. Las bandas criminales o comúnmente conocidas BACRIM según el gobierno1 no cumplen los requisitos para adquirir la connotación de grupo armado y se definen como delincuencia común, sin embargo por medio del auto 119 de 2013 proferido por la Honorable Corte Constitucional sus víctimas fueron reconocidas bajo la implementación de La Ley de Víctimas y Restitución de Tierras, el presente trabajo no pretende negar el reconocimiento de dicho derecho realizado por la Corte Constitucional bajo el derecho a la igualdad, pilar del Estado Social y Democrático de Derecho sino analizar bajo los supuestos del Derecho Internacional dicha inclusión y sus repercusiones respecto a la construcción del marco jurídico para la paz y la sostenibilidad fiscal de la misma ley
The Law of Victims and Land Restitution is the set of measures necessary to achieve the principles of Transitional Justice in Colombia, truth, justice and reparation for victims during the armed conflict. To speak of armed conflict not of an international character under the Protocol Additional to the Geneva Conventions of 1949 "on the protection of victims of armed conflict not of an international character in 1977", there must be confrontations between the state and armed actors dissenters always and when they have i) command responsible ii) sufficient to iii) territorial control and conduct military operations iv) apply humanitarian norms. Criminal gangs or commonly known BACRIM according to government1 not meet the requirements to acquire the connotation of armed group and are defined as common criminals, but through self 119 2013 handed down by the Honorable Constitutional Court its victims were recognized under implementation the Law of Victims and Land Restitution, this paper is not to deny the recognition of this right by the Constitutional Court on the right to equality pillar of the social and democratic state of law but analyzed under the assumptions of this International Law inclusion and its impact regarding the construction of the legal framework for peace and fiscal sustainability of the Act.
