Abstract
El presente ensayo de reflexión tiene como objetivo evidenciar la necesidad de identificar el modelo y alcance del control de convencionalidad en relación con la actividad del juez penal colombiano al momento de determinar la pena a imponer. Para ello se aplica el método hermenéutico analítico con enfoque cualitativo, para ello se realiza un breve análisis al mecanismo de Control de Convencionalidad, incorporado por la Corte Interamericana de Derechos Humanos en el orden regional y su interacción en el contexto jurídico penal nacional, concretamente con la función del juez al determinar la pena a imponer; a partir de la concepción de control de convencionalidad como instrumento que garantiza la prevalencia de las obligaciones convencionales suscritas por el Estado signatario en el marco de protección y garantía de los Derechos Humanos.
The present essay of reflection aims to demonstrate the need to identify the model and scope of the control of conventionality in relation to the activity of the Colombian criminal judge when determining the penalty to be imposed. For this, the analytical hermeneutical method is applied with a qualitative approach. For this purpose, a brief analysis is carried out on the Conventional Control mechanism, incorporated by the Inter-American Court of Human Rights in the regional order and its interaction in the national criminal legal context, The role of the judge in determining the penalty to be imposed; From the conception of control of convention as an instrument that guarantees the prevalence of the conventional obligations subscribed by the signatory State within the framework of protection and guarantee of Human Rights.
