Resumen
Uno de los aspecto fundamentales de un Estado Social de Derecho como el nuestro, es el control al cual deben estar sometidos los ciudadanos, más aún, si se les ha endilgado funciones públicas. De esta idea se desliga la importancia del Derecho Sancionador, el cual es una herramienta que ayuda a contrarrestar a través de investigaciones y sanciones, las conductas antijurídicas –sean acciones u omisiones- que atenten contra los fines del Estado. He ahí la permanente lucha del gobierno por construir un cuerpo normativo que de forma efectiva sirva como instrumento para combatir la corrupción. Una norma eficaz que pueda ser utilizada para la defensa de los intereses comunes. Así surge el ánimo por reorganizar y complementar el ya unificado Código Disciplinario. Por lo anterior es de suma importancia analizar los principales cambios sustanciales y procesales como la inclusión de algunos principios mínimos, la definición de los conceptos de dolo y culpa y el ajuste y clarificación de la prescripción.
One of the pillars of the Social State of Law, as it is established in our country is that the actions of its citizens must be subject to legal control; especially when they have been given public functions. This is where Administrative Law Penalties grow in importance, as they are a tool that helps to investigate and sanction those unlawful conducts- whether actions or omissions- that prove to be against the purposes of the State. This is why the current Government has struggled to build a normative body that will effectively serve as an instrument against corruption. An efficient set of rules that can be used to defend the public interests. In line with all this the idea to re-organise and complement the already Unified Disciplinary Code has been proposed. For this to be accomplished it is of pivotal importance to analyse the main changes, both substantive and procedural, such as the introduction of minimum principles, the definition of the concepts of wrongdoing and gross negligence, and the clarifying of the figure of prescription.
