Abstract
El presente artículo de investigación comprendió el abordaje del conflicto de intereses que representa en medio del proceso penal, la ejecución de actividades de esclarecimiento del delito por parte del Estado sujetas a control posterior, y la protección del derecho fundamental a la intimidad del investigado.
En esa medida, la pregunta de investigación formulada apuntó a la identificación del elemento legitimador de las medidas de injerencia dictadas por la Fiscalía tendientes a la limitación del derecho fundamental a la intimidad del investigado; considerando que la contraposición de ambos intereses debe hallar un punto arquimédico de solución al interior del Estado Constitucional de Derecho colombiano.
Se identificó como elemento legitimador de tales medidas el empleo de una “motivación fundada”, como uno fundamental tratándose de la limitación de derechos fundamentales en la etapa de investigación procesal, pero que en la normativa interna carece aún del desarrollo deseado.
This article research included the approach of conflict of interest in representing through the criminal proceedings, the implementation of activities to clarify the crime by the State subject to subsequent control, and protection of the fundamental right to privacy under investigation.
To that extent, the research question formulated aimed at legitimizing identification element interference measures dictated by the prosecution aimed at limiting the fundamental right to privacy under investigation; whereas the opposition of both interests must find a central solution point within the Colombian constitutional rule of law.
The use of a " founded motivation " was identified as legitimizing element of such measures as one important case of the limitation of fundamental rights in the procedural stage of research, but in the domestic legislation still lacks the desired development.
