Abstract
Una de las áreas del derecho sancionatorio es el derecho disciplinario, el cual abarca a su vez dos enfoques, uno de carácter administrativo y el otro jurisdiccional, este último es el encargado de investigar el comportamiento de funcionarios judiciales y de abogados en el ejercicio de la profesión. En este artículo se determinarán las razones por las cuales se presenta una responsabilidad objetiva en el derecho jurisdiccional disciplinario al momento de evaluar las conductas cometidas por funcionarios judiciales, así como las consecuencias del no análisis de la ilicitud sustancial, para luego entrar a proponer una salida al problema, dejando el tema abierto a debate, en atención a que sobre el mismo, en lo académico, es poco lo que se ha deliberado.
One area of the punitive administrative law is the disciplinary law which covers two approaches, one administrative and the other judicial, the latter being in charge of investigating not only the judicial officer's conduct, but also the attorneys’ behavior in the exercise of their profession. The reasons why the strict liability exists in the disciplinary jurisdictional right when investigating conducts committed by judicial officers and the consequences of not analyzing the substantial unlawfulness will be determined in this article. Finally, bearing in mind that there has been a little deliberated in the academic sphere, we make a proposal about how to solve that problem, leaving the issue open to debate.
