Abstract
El presente Artículo se desarrolla entorno al análisis descriptivo de los Principios de Independencia, Autonomía e Imparcialidad de la Justicia Penal Militar colombiana, partiendo del origen y la evolución con que actúa simultáneamente, ejerciendo su función jurídica y de comando; a partir del Decreto 2550 de 1988, en que se establecen los lineamientos actuales que permiten a los miembros de la Fuerza Pública ejercer ambas funciones al mismo tiempo. Para entender el problema se analizó la pertinencia que hay en el procedimiento judicial, cuando el personal que juzga no se encuentra técnicamente habilitado para desarrollar esa función por carecer de formación jurídica profesional y se llega a depender de terceras personas para emitir los fallos, lo que es contrario a los principios de independencia e imparcialidad. Ante lo cual, los resultados y sus análisis se desarrollaron mediante una investigación descriptiva, en que se cita la creación de la Ley 522 de 1999 actual Código Penal Militar, en que se establece que dichas funciones fueron separadas y prohibidas, de acuerdo al análisis de los principios en relación con la normativa Penal Militar vigente y sus consecuencias
The present article is developed around the descriptive analysis of the Principles of Independence, Autonomy and Impartiality of the Colombian Military Criminal Justice, starting from the origin and the evolution with which it acts simultaneously exercising, its legal and command function; Since Decree 2550 of 1988, which establishes the current guidelines that allow the members of the Public Force to exercise both functions at the same time. In order to understand the problem, the pertinence of the judicial procedure was analyzed, when the personnel who judges are not technically qualified to perform this function because they lack professional legal training and come to depend on third parties to issue the judgments, which Is contrary to the principles of independence and impartiality. To this end, the results and their analyzes were developed through a descriptive investigation supported by a case study, which cites the creation of Law 522 of 1999, which corresponds to the current Military Penal Code, which establishes that these functions Were separated and banned, according to the analysis of the principles in relation to the Military Criminal Law in force and its consequences
