Resumen
Este artículo realiza un estudio del desarrollo jurisprudencial constitucional frente al derecho a objetar la conciencia, en el deber de cumplir con el servicio militar obligatorio. Esta investigación tiene un corte histórico entre 1992 y 2016, para responder a la pregunta: ¿Cuál es el desarrollo evolutivo jurisprudencial por parte de la Corte Constitucional frente a la objeción de conciencia en el caso de las Fuerzas Militares de Colombia?, logrando identificar que entre 1991 y octubre de 2009, todos los fallos habían negado la objeción de conciencia como eximente para el servicio militar obligatorio, a partir de la sentencia C-728 de este año, se expidió la jurisprudencia que la acepta; pero que de todas formas las Fuerzas Militares, no ha desarrollado un sistema que permita a los objetores de conciencia obtener la libreta militar de forma fácil, toda vez que se encontraron muchas sentencias con fallos en este sentido.
This article makes a study of the constitutional jurisprudential development in front of the right to object the conscience, in the duty of fulfilling the obligatory military service. This investigation has a historical cut between 1992 and 2016, to answer the question: What is the jurisprudential evolutionary development on the part of the Constitutional Court in front of the conscientious objection in the case of the Military Forces of Colombia ?, being able to identify that between 1991 and October 2009, all the rulings had denied conscientious objection as an exemption for compulsory military service, as of this year's C-728 ruling, the jurisprudence that accepts it was issued; but that in any case the Military Forces, has not developed a system that allows the conscientious objectors to obtain the military passbook in an easy way, since many sentences were found with failures in this sense.
