Abstract
El presente escrito pretende analizar aspectos relacionados con la justicia transicional en el escenario del post acuerdo en Colombia, específicamente tomándose como punto de partida la definición de los mismos y la garantía de los Derechos Humanos de las victimas dentro de las diferentes etapas de su desarrollo y entender cómo se proyecta éste, en el país. Lo anterior, a partir de la normativa internacional, específicamente los mecanismos internacionales de protección del derecho, la justicia y la actuación de la comunidad internacional frente al proceso transicional; por su parte, en el ámbito nacional dicho análisis tendrá en cuenta los principios definidos por la ley 1448 de 2011 Ley de Víctimas y Restitución de Tierras como son: la reparación integral, la justicia y la Garantía de no repetición y de otro lado la justicia especial para la paz y los retos que ésta plantea, además de la interpretación que la Corte Constitucional ha hecho en materia de esa justicia transicional y los derechos que incorpora en la legislación colombiana, así como de la materialización de este derecho en la realidad fáctica de nuestro país.
De otro lado, se hace necesario realizar un análisis comparativo con procesos llevados a cabo en países como Ruanda, que si bien obtuvieron la Paz, esta se dio en condiciones diferentes a las de Colombia, pero compartiendo un aspecto neurálgico del proceso, como es la discusión del tema de las condenas a los culpables de delitos de lesa humanidad, el cual ha divido la opinión pública y ha desvirtuado de alguna manera el propósito general de los acuerdos con las FARC, al situar en el centro de la discusión, el respeto por las víctimas; lo que a juicio de algunos sectores, queda mancillado, ya que a cambio de condenas ejemplarizantes a los victimarios, éstos recibirán curules en el Congreso de la Republica.
Abstract This article intends to analyze aspects related to transitional justice in the post-agreement scenario in Colombia, specifically taking as a starting point the definition of them and the guarantee of the Human Rights of the victims within the different stages of their development and understand how this is projected, in the country. The foregoing, based on international regulations, specifically the international mechanisms for the protection of law, justice and the actions of the international community in the face of the transitional process; For its part, at the national level, this analysis will take into account the principles defined by Law 1448 of 2011 Law on Victims and Land Restitution, such as: comprehensive reparation, justice and the guarantee of non-repetition and, on the other hand, special justice for peace and the challenges it poses, in addition to the interpretation that the Constitutional Court has made regarding this transitional justice and the rights it incorporates in Colombian legislation, as well as the materialization of this right in the factual reality of our country. On the other hand, it is necessary to carry out a comparative analysis with processes carried out in countries such as Rwanda, which although obtained the Peace, this was given in different conditions to those of Colombia, but sharing a neuralgic aspect of the process, as is the discussion of the issue of sentences for those guilty of crimes against humanity, which has divided public opinion and has in some way distorted the general purpose of the agreements with the FARC, by placing at the center of the discussion, respect for the victims : what in the opinion of some sectors, is tarnished, since in exchange for exemplary sentences to the perpetrators, they will receive seats in the Congress of the Republic.
