Resumen
Del análisis realizado a la ley, jurisprudencia de la Corte Constitucional y Corte Suprema de Justicia, se evidenció la existencia de factores que violan el principio de autenticidad, diferentes a las causas que rompen la cadena de custodia que se aplica a los elementos de prueba aportados al proceso penal. La investigación se realizó a partir del enfoque funcionalista y consultas de carácter bibliográfico, siendo Chiesa A, el referente teórico. La respuesta a la pregunta de investigación surgió del análisis a la ruptura que existe entre el proceso de cadena de custodia y el principio de autenticidad, siguiendo el método inductivo-deductivo. Dicho análisis dio como respuesta única correcta posible y no variable, que la no acreditación de la evidencia, su identidad, originalidad, conservación y eficacia, son factores que violan el principio de autenticidad. Finalmente la validación de los resultados investigativos se hizo a través del método de contrastación referencial.
From the analysis made to the law, jurisprudence of the Constitutional Court and Supreme Court of Justice, the existence of factors that violate the principle of authenticity, different from the causes that break the chain of custody that applies to the elements of evidence, was evidenced, contributed to the criminal process. The research was carried out based on the functionalist approach and bibliographic queries, being Chiesa A, the theoretical reference. The answer to the research question arose from the analysis of the rupture that exists between the process of chain of custody and the principle of authenticity, following the inductive-deductive method. This analysis gave the only correct answer possible and not variable, that the non-accreditation of the evidence, its identity, originality, conservation and effectiveness, are factors that violate the principle of authenticity. Finally, the validation of the research results was done through the referential testing method.
