Abstract
Con la presente investigación se pretende analizar cuál fue la gestión adelantada por las oficinas de Control Interno de los diferentes Municipios del Departamento de Cundinamarca, durante la vigencia 2016, con ocasión de los hallazgos con reproche fiscal evidenciados por la Contraloría de Cundinamarca, en el citado año fiscal, en cumplimiento del –PGA- Plan General de Auditorías 2017. En este aspecto se hace indispensable indicar, que de acuerdo con los preceptos constitucionales, el Control Fiscal es ejercido por las Contralorías de manera posterior y selectiva, entendiéndose por control posterior la vigilancia de las actividades, operaciones y procesos ejecutados por los sujetos de control y de los resultados obtenidos por los mismos y selectivo la elección mediante un procedimiento técnico de una muestra representativa de recursos, cuentas, operaciones o actividades para obtener conclusiones sobre el universo respectivo en el desarrollo del control fiscal
En efecto, el artículo 269 de la CPN, las entidades públicas están obligadas a diseñar y aplicar, según la naturaleza de sus funciones, métodos y procedimientos de control interno, de conformidad con lo que disponga la ley, la cual podrá establecer excepciones y autorizar la contratación de dichos servicios con empresas privadas colombianas.
No obstante lo anterior, y según el diagnóstico elaborado por la Oficina de Control Interno de la Contraloría de Cundinamarca, acerca del funcionamiento del Control Interno en las entidades a las que se le ejerce el control fiscal, se evidencia que el 49.61% de los municipios no tienen, dentro de su estructura organizacional, la Oficina de Control Interno, y por ende dichas funciones radican en cabeza de los Secretarios de Planeación y de Gobierno. Esta Circunstancia, impide que las atribuciones en cabeza de un ser ajeno a la Administración, tenga la independencia, objetividad y libertad, además se debe tener una actitud neutral e imparcial y evitar conflicto de intereses, características que no poseen, toda vez que forman parte activa de los procesos que desarrolla la Entidad, máxime cuando son supervisores de los contratos celebrados y que es en esta línea donde se presentan los mayores riesgos en la correcta inversión de los recursos públicos.

Notwithstanding the above and according to the diagnosis made by the Office of Internal Control of Cundinamarca about the Office of the Comptroller of Internal Control of the Entities that are subject to the Control, it is evident that 49.61% of the municipalities do not have an Internal Control Office and that the functions are carried out by the Secretaries of Planning and Government, thus preventing an independent, objective and interference-free function from being carried out, in addition, a neutral and impartial attitude must be taken and conflicts of interest avoided, characteristics that they do not possess since they form part of of the processes developed by the Entity, especially when they are supervisors of the contracts entered into and that it is in this line where the greatest risks are presented in the correct investment of public resources.
