Resumen
Colombia está concebida como un Estado Social de Derecho y en razón a ello la función administrativa se encuentra al servicio de los intereses generales y se desarrolla con fundamento en los principios de igualdad, moralidad, eficacia, economía, celeridad, imparcialidad y publicidad, mediante la descentralización, la delegación y la desconcentración de funciones, (Constitución Política de Colombia, 1991), lamentablemente a lo largo de la historia, el país ha sufrido el flagelo de la corrupción y la naturaleza de dicha función se ha visto afectada, es por ello que el Legislador y las propias instituciones han adoptado herramientas tales como el control fiscal a través del cual se procura garantizar el buen uso y cuidado de los recursos públicos, así como la imposición de sanciones resarcitorias cuando se afecte el patrimonio público; sin embargo frente a las numerosas situaciones que han afectado gravemente el patrimonio de la Nación por el fenómeno de la corrupción se ha puesto en tela de juicio en el debate nacional la operatividad misma del control Fiscal y las entidades que lo ejercen en el nivel nacional como territorial. Por tales motivos la presente investigación pretende analizar, si en efecto el control fiscal tal y como está contemplado en Colombia cuenta con los elementos que le permiten desarrollarse de manera eficiente, eficaz y articulada entre los territorios y la Nación, o si por el contrario se requiere una reforma integral que permita una eficiente articulación entre el control fiscal nacional y territorial o que se concentre en un solo órgano su función; para tal fin se tendrán en cuenta los diferentes puntos de vista entorno a modificaciones formales, legales y Constitucionales del control fiscal en Colombia.
Colombia is conceived as a Social State of Law and because of that the administrative function is at the service of general interests and is developed based on the principles of equality, morality, efficiency, economy, speed, impartiality and publicity, through the decentralization, delegation and deconcentration of functions, (Political Constitution of Colombia, 1991), unfortunately throughout history, the country has suffered the scourge of corruption and the nature of this function has been affected, that is why that the Legislator and the institutions themselves have adopted tools such as fiscal control through which it seeks to ensure the proper use and care of public resources, as well as the imposition of sanctions when the public patrimony is affected; However, in the face of the numerous situations that have seriously affected the Nation's heritage due to the phenomenon of corruption, the very effectiveness of the Fiscal control and the entities that exercise it at the national level have been questioned in the national debate. territorial. For these reasons the present investigation intends to analyze, if indeed the fiscal control as contemplated in Colombia has the elements that allow it to develop efficiently, effectively and articulated between the territories and the Nation, or if on the contrary it is it requires an integral reform that allows an efficient articulation between the national and territorial fiscal control or that concentrates in a single organ its function; for this purpose, the different points of view regarding formal, legal and Constitutional modifications of fiscal control in Colombia will be taken into account.
