Resumen
El derecho colombiano proviene de una de las dos grandes vertientes de esta ciencia denominada Derecho Continental, el cual se desarrolló en la Europa continental con base en los principios del denominado derecho romano-germánico, en contraposición al Common Law, sistema jurídico que se desarrolló en Inglaterra y que se ha extendido a la mayoría de los países anglosajones. La principal fuente del Derecho Continental es la ley, mientras que la principal fuente del Common Law es el precedente, es decir, las decisiones tomadas con anterioridad por otros tribunales.
Hace algunos años la docencia del Derecho en Colombia se practicaba siguiendo los parámetros de la escuela tradicional, es decir, el docente trasmitía el conocimiento y los alumnos eran simples receptores del mismo, reinaba la cátedra magistral, en donde el centro de la atención en el aula era el docente, y la estudiantes eran sujetos pasivos.
De otra parte la mayoría de docentes de las facultades de Derecho eran profesores de cátedra, es decir, que no eran de tiempo o dedicación completa, lo que dificultaba que el estudiante recibiera una atención integral en su proceso de aprendizaje. Adicionalmente, los profesores de Derecho eran abogados en algunos casos sin formación en docencia, por lo que en este proceso de aprendizaje se carecía de herramientas pedagógicas.
Con el transcurso del tiempo la enseñanza del Derecho en Colombia se ha ido amoldando a los nuevos enfoques educativos, es así como el Ministerio de Educación Nacional estableció el modelo de educación basada en competencias (EBC) para la formación de los nuevos abogados, en donde el docente ya no es un simple transmisor de conocimiento, sino que se convierte en un facilitador, y por su parte el estudiante pasa a ser un sujeto activo en el proceso de construcción del conocimiento, con un pensamiento crítico y analítico.
Igualmente debido a las nuevas políticas del Ministerio de Educación Nacional, las facultades de Derecho de Colombia deben contar con docentes de tiempo completo, o de dedicación completa, como en efecto está ocurriendo, por lo que en consecuencia hoy coexisten junto con los profesores de cátedra.
Para la realización de este trabajo se siguió el método descriptivo cualitativo documental, basado en la revisión disponible sobre autores, instituciones y documentos indexados, que han permitido referenciar el tema.
Colombian law comes from one of the two main aspects of this science that has been called Continental Law, that is, the one that developed in continental Europe based on the principles of the so-called Roman-Germanic law, as opposed to the Common Law. Law, legal system that was developed in England and that has been extended to the majority of the Anglo-Saxon countries. The main source of continental law is the law, while the main source of common law is the precedent, that is, the decisions taken previously by other courts.
Some years ago the teaching of Law in Colombia was practiced following the parameters of the traditional school, that is, the teacher transmitted the knowledge and the students were simple recipients of it, the master chair reigned, where the center of attention in the classroom was the teacher, and the students were passive subjects.
On the other hand, the majority of faculty members of law faculties were professors, that is, they were not full time or dedication, which made it difficult for the student to receive comprehensive attention in their learning process. Additionally, law professors were lawyers in some cases without teaching training, so in this learning process there was a lack of pedagogical tools.
Over time, the teaching of Law in Colombia has been adapting to new educational approaches, this is how the Ministry of National Education established the competency-based education model (EBC) for the training of new lawyers, where the teacher is no longer a simple transmitter of knowledge, but becomes a facilitator, and for his part the student becomes an active subject in the process of knowledge construction, with critical and analytical thinking.
Likewise, due to the new policies of the Ministry of National Education, Colombian law faculties must have full-time or full-time teachers, as indeed it is happening, which is why today they coexist together with the professors of the chair.
In order to carry out this work, the documentary qualitative descriptive method was followed, based on the available revision on authors, institutions and indexed documents, which allowed to refer the subject.
