Resumen
El concepto de reparación simbólica como derecho de las víctimas del conflicto representa un gran reto para la justicia restaurativa pues la traslada a resarcir aquellos daños que por su naturaleza son irreparables. Sin embargo, estos actos simbólicos al realizarse generalmente bajo elementos artísticos que como expresión de las victimas refieren a su dignificación mediante la dialéctica social, vislumbran un reto para el derecho, pues se hace necesario la integración de modelos pedagógicos que planteen el arte como un camino que se traduzca en la satisfacción de un derecho concreto.
Como aporte al reto establecido por el proceso de justicia transicional colombiano se plantea la dramaturgia y su construcción por parte de la víctima como un elemento que bajo criterios jurídico - experimentales significara una herramienta para la dignificación, re significación y resiliencia. La viabilidad metodología se sustenta en una investigación histórico – jurídica y jurídico - dogmática como abstracción de la realidad de las víctimas y la sociedad sobre la significación del acto simbólico en medio de estados de fracturación social y democrática.
The concept of symbolic reparation as a right of the victims of the conflict represents a great challenge for restorative justice as it moves to compensate those damages that by their nature are irreparable. However, these symbolic acts to be performed generally under artistic elements that as an expression of the victims refer to their dignification through social dialectics, they see a challenge for the right, because it is necessary to integrate pedagogical models that pose art as a path that translates into the satisfaction of a specific right.
As a contribution to the challenge established by the Colombian transitional justice process, dramaturgy and its construction by the victim is considered as an element that under legal - experimental criteria would mean a tool for dignification, re signification and resilience. The feasibility methodology is based on a historical - legal and legal - dogmatic investigation as an abstraction of the reality of the victims and society on the significance of the symbolic act in the midst of states of social and democratic fracturing
