Abstract
En la actualidad Colombia presenta una amplia normativa frente a la gestión del recurso hídrico inherente al tratamiento de aguas, la cual incluye la reglamentación de los requisitos técnicos del diseño, mantenimiento y operación de la infraestructura para su tratamiento; además determina su ordenamiento, protección, conservación, uso y aprovechamiento. Sin embargo, es desconcertante que el régimen jurídico existente a nivel nacional aún es débil y laxo frente al contemplado en otros países, como la disposición del material resultante del tratamiento de aguas residuales, explícitamente lodos residuales. El presente artículo pretende cuestionar e indagar la normativa existente con respecto al Tratamiento de Aguas Residuales en el territorio nacional, para el caso que implica la adecuada disposición final de los lodos residuales. Cabe resaltar que los requerimientos regulatorios pueden reducir, mitigar y a largo plazo prevenir los daños identificados principalmente en la afectación del recurso suelo, desencadenando problemas de “bioacumulación” y “biomagnificación” de metales pesados y sustancias tóxicas derivadas de las diferentes actividades productivas.
At present Colombia presents a wide normative regarding the management of the hydric resource inherent to the water treatment, which includes the regulation of the technical requirements of the design, maintenance and operation of the infrastructure for its treatment; it also determines its order, protection, conservation, use and exploitation. However, it is disconcerting that the existing legal regime at the national level is still weak and lax compared to that contemplated in other countries, such as the disposal of the material resulting from the treatment of wastewater, explicitly residual sludge. This article aims to question and investigate the existing regulations regarding the treatment of wastewater in the national territory, for the case that implies the proper disposal of the residual sludge. It should be noted that the regulatory requirements can reduce, mitigate and in the long term prevent the damages identified mainly in the affectation of the soil resource, triggering problems of "bioaccumulation" and "biomagnification" of heavy metals and toxic substances derived from the different productive activities.
