Abstract
Como derecho constitucional fundamental el debido proceso en Colombia fue consagrado en la parte dogmática de la Constitución Política de 1991, con la intención de ofrecerle a las personas un proceso con las garantías mínimas de imparcialidad y justicia; pretendiendo con ello contar con un instrumento jurídico que sirva de contrapeso a los abusos de las autoridades en desarrollo de cualquiera de sus actuaciones, en atención a que la ley de leyes ubicó en el centro a la persona humana considerada no como un individuo aislado, sino como un ser dotado de personalidad propia, a quien el Estado debe garantizar siempre y en todo lugar la efectividad de sus derechos.
As a fundamental constitutional right due process in Colombia was enshrined in the dogmatic part of the Political Constitution of 1991 with the intention of offering people a process with the minimum guarantees of impartiality and justice, pretending to have a legal instrument that would serve of counterbalance to the abuses of the authorities in development of any of their actions, in attention to the fact that the law of laws placed in the center the human person considered not as an isolated individual, but as a being endowed with its own personality, to whom The State must always and everywhere guarantee the effectiveness of their rights.
