Abstract
A lo largo de los últimos meses, se ha venido escuchando sobre la problemática que genero el paro de los pilotos de Avianca, y del caos que este conllevo hasta afectar varios sectores de la economía colombiana. Esta problemática laboral, no solo afecto a la compañía del sector aéreo como tal, sino que también nos hizo dar cuenta la dependencia que tiene la Nación en los diferentes mercados en los que también se vieron afectados por el cese de actividades de los pilotos de tan prestigiosa compañía. Asimismo, se pudo evidenciar la falta de pluralidad en el servicio aéreo comercial colombiano, para mitigar un poco el caos que género la ausencia de ciertas rutas de la aerolínea anteriormente mencionada.
Dada la ratificación de servicio público esencial establecida por la Corte Suprema de Justicia en 2017, se le dará un recorrido breve por lo que conlleva el tener al transporte aéreo como un servicio público esencial y la capacidad que tiene el Estado para garantizarla.
Over the last few months, we have been hearing about the problems caused by the Avianca pilots' unemployment, and the chaos that this has led to affecting several sectors of the Colombian economy. This labor problem, not only affected the airline industry as such, but also made us realize the dependence that the Nation has in the different markets in which they were also affected by the cessation of activities of the pilots of prestigious company. Likewise, the lack of plurality in the Colombian commercial air service could be evidenced, to mitigate a little the chaos that gender the absence of certain routes of the aforementioned airline.
Given the ratification of essential public service established by the Supreme Court of Justice in 2017, it will be given a brief tour of what it takes to have air transport as an essential public service and the capacity of the State to guarantee it.
