Abstract
Las comunidades indígenas son una parte de la población colombiana que ha sido afectada durante siglos por la problemática social, cultural, económica, política y ambiental de toda la sociedad. Uno de los problemas más evidentes, es la violación a los Derechos Fundamentales de estas poblaciones, hechos, que han sido de conocimiento del Estado, pero no se han creado mecanismos que den soluciones efectivas y puedan mejorar la calidad de vida de estas comunidades. Con base en lo anterior, en este proyecto se profundizará acerca de la violación específica de dos Derechos: el Derecho al territorio y el derecho al agua. Por medio de un análisis del impacto de la actividad minera colombiana, específicamente de la Mina el Cerrejón ubicada en el Departamento de La Guajira que ha afectado de forma irremediable a la comunidad Wayúu, desviando uno de los principales ríos de la zona; el río Ranchería fuente principal de alimento y desarrollo comunal.
Adicionalmente, se busca evaluar las diferentes posturas que se presentan frente al Derecho al agua y al territorio ancestral. Dando a conocer quiénes son los Indígenas Wayuu y que afectaciones sociales, culturales, territoriales y ambientales se han causado por la explotación minera en la zona. Posteriormente verificaremos el respectivo marco Legal y Constitucional del Estado Colombiano para la protección de estos derechos, analizando la normativa actual y su efecto vinculante.
The indigenous communities are a part of the Colombian population that has been affected for centuries by the social, cultural, economic, political and environmental problems of the whole society. One of the most obvious problems is the violation of the fundamental rights of these populations, facts that have been known to the State, but mechanisms have not been created to provide effective solutions and improve the quality of life of these communities. Based on the above, this project will deepen the specific violation of two rights: the right to territory and the right to water. Through an analysis of the impact of the Colombian mining activity, specifically the Cerrejón mine located in the Department of the Guajira, which has irreparably affected the Wayúu community, diverting one of the main rivers in the area; The River Rancheria main source of food and communal development.
In addition, it seeks to evaluate the different positions that are presented in front of the right to water and ancestral territory. Giving to know who the indigenous Wayuu are and that social, cultural, territorial and environmental affections have been caused by the mining in the area. Later we will verify the respective Legal and constitutional framework of the Colombian State for the protection of these rights, analyzing the current legislation and its binding effect.
