Abstract
Las violaciones originadas en el debido proceso y que han sido causal de nulidad en algunos procesos de la justicia penal militar, constituyen también violaciones al principio de especialidad funcional de los integrantes de la Fuerza Pública, teniendo en cuenta que las citaciones para adelantar las notificaciones fueron enviadas a las direcciones plasmadas en las denuncias o en las declaraciones rendidas por parte de los procesados al iniciar las investigaciones, datos de ubicación que no se mantuvieron en el tiempo; teniendo en cuenta que por la función Constitucional que desempeñan y por las necesidades del servicio propias de la fuerza pública, se generan traslados a diferentes lugares del territorio nacional que deben ser cumplidos sin objeción alguna y la administración debe garantizar el principio de especialidad a sus procesados para que asistan de forma oportuna al llamado de los despachos que los requieran.
The violations originated in the due process and that have been grounds for nullity in some military criminal justice processes, also constitute violations of the functional specialty principle of the members of the Public Force, taking into account that the summons to advance the notifications were sent to the addresses shown in the complaints or in the statements made by the defendants at the beginning of the investigations, location data that were not maintained in time; taking into account that for the Constitutional function they perform and for the service needs of the public force, transfers are generated to different parts of the national territory that must be met without any objection and the administration must guarantee the principle of specialty to its defendants so that they attend the call of their offices in a timely manner.
