Abstract
Debemos entender que la sociedad actual contemporánea se identifica por ser globalizada y de riesgo, en tal sentido es una sociedad multidimensional y vive en unos cambios constantes frente a los procesos de interacción políticos, sociales, económicos, tecnológicos y culturales que impactan de manera significativa las relaciones sociales, jurídicas, y por supuesto, la política criminal. Parte del problema que debe enfrentar el sistema judicial colombiano es la delincuencia organizada, y manifiestas a través de organizaciones de narcotráfico, de falsificación de moneda, trata de personas, bandas de delincuencia común, entre otros. La criminalidad en Colombia no es propia de un municipio o ciudad, ya que estas organizaciones sobrepasan las fronteras, es decir se está frente a la globalización del delito, lo que implica desarrollar procedimientos investigativos ágiles que permitan contener estas organizaciones delictivas.
Una de las estrategias para combatir las actividades delictivas y lograr desmantelarlas, utilizada como técnica de investigación en diferentes países, es el agente encubierto.
En Colombia, un funcionario de la policía judicial con el fin de obtener información para cierto tipo de investigaciones se infiltra en la organización delictiva para conocer su estructura, sus actividades, las relaciones y sus integrantes.
Ahora bien, las actividades que realiza en función de su labor, implican ciertas condiciones especiales que de una u otra forma pueden afectar la legalidad de la actuación. Por ello, la importancia de revisar las técnicas de investigación con el fin de delimitar las acciones sin afectar la eficacia de la misma, ni los derechos fundamentales de los individuos.
We must understand that contemporary contemporary society is identified as being globalized and risky, in that sense it is a multidimensional society and lives in constant changes in the face of political, social, economic, technological and cultural interaction processes that significantly impact the social relations, legal, and of course, criminal policy.
Part of the problem that the Colombian judicial system must face is organized crime, and you manifest through drug trafficking, counterfeit money organizations, human trafficking, common crime gangs, among others.
Criminality in Colombia is not typical of a municipality or city, since these organizations go beyond borders, that is, they face the globalization of crime, which implies developing agile investigative procedures that allow these criminal organizations to be contained.
One of the strategies to combat criminal activities and dismantle them, used as a research technique in different countries, is the undercover agent.
In Colombia, a judicial police officer in order to obtain information for certain types of investigations infiltrates the criminal organization to know its structure, its activities, relationships and its members.
However, the activities carried out according to their work, imply certain special conditions that in one way or another may affect the legality of the action. Therefore, the importance of reviewing research techniques in order to delimit the actions without affecting their effectiveness, nor the fundamental rights of individuals.
