Resumen
El sistema punitivo premial se constituye como un conjunto de reglas de atenuación o remisión total de la pena, conducentes a premiar conductas que permitan cumplir con el imperativo de “justicia” o la subvención con las autoridades para desmantelar esquemas criminales. En ese sentido, el preacuerdo como instrumento novedoso del sistema procesal penal, exhibe la necesidad de establecer parámetros legales sobre negociaciones que efectúan la Fiscalia y defensa, toda vez que, el derecho penal premial permite a las partes negociaciones de toda índole, donde admite el reconocimiento de responsabilidad y tipicidad del procesado. Empero, esta figura perjudica los aspectos que comprende prevención general, retribución justa y prevención especial, constituyendo un problema de legalidad que debemos resolver de manera dogmática mediante la técnica de una definición jurídica que atienda las consecuencias jurídicas en disfavor de las funciones de la pena, la víctima y la sociedad.
The punitive reward system is constituted as a set of rules of mitigation or total remission of the penalty, leading to rewarding conduct that allows compliance with the imperative of "justice" or subsidizing the authorities to dismantle criminal schemes. In this sense, the pre-agreement, as a novel instrument of the criminal procedure system, shows the need to establish legal parameters for the negotiations carried out by the Public Prosecutor's Office and the defense, since premium criminal law allows the parties to negotiate of all kinds, where it admits the recognition of the responsibility and typical nature of the defendant. However, this figure damages the aspects that comprise general prevention, fair compensation and special prevention, constituting a problem of legality which we must resolve dogmatically through the technique of a legal definition that addresses the legal consequences to the detriment of the functions of the penalty, the victim and society.
