Resumen
No es una novedad que los medios alternativos de solución de conflictos estén ganando terreno en comparación con la justicia ordinaria, con sano criterio es una realidad que la mora judicial y los constantes escándalos que permean la rama judicial no permitan crear sanamente una imagen favorable entre quienes acuden en busca de justicia, al momento de accionar el aparato jurisdiccional colombiano, de ahí el hecho que las partes en debate, opten por formas autocompositivas de solución de conflictos, llegando al arbitraje como medio de arreglo de controversias, con todo y lo anterior, acudir al arbitraje trae intrínsecos ciertos beneficios, incluyendo la solicitud, decreto y práctica de medidas cautelares, permitiendo salvaguardar el derecho a la tutela judicial efectiva, no obstante que con el inciso quinto del artículo 43 de la ley 1563 de 2012, al prohibir la ejecución del laudo al tribunal de arbitramento, dificulta y limita la efectividad del laudo y de las mismas medidas cautelares decretadas y practicadas, por cuanto para la ejecución del laudo se debe acudir a la justicia ordinaria. Con la expedición del Estatuto de Arbitraje Nacional e Internacional se permite que dentro del proceso se decreten (previa solicitud de la parte interesada), todas las medidas cautelares que, según el caso en estudio, serían las adecuadas para proteger los derechos objeto del litigio, impedir su infracción o evitar las consecuencias derivadas de la misma, prevenir daños, hacer cesar los que se hubieren causado o asegurar la efectividad de la pretensión, aduciendo a lo que la ley llamó medidas cautelares innominadas; argumento que resulta análogo a cualquier proceso que se adelante en la jurisdicción ordinaria, lo novedoso es que el árbitro solo tiene jurisdicción por un determinado tiempo, son jueces transitorios, es decir, es ad-hoc (para el caso en concreto), fundamento que hace la gran diferencia en lo que respecta a que particulares administren justicia, hasta tal punto que solo se permita acudir al arbitraje a ventilar asuntos de libre disposición y aquellos que autorice la ley; siendo renuente el legislador en prohibir que se adelanten por el trámite arbitral procesos ejecutivos, aduciendo que sería una desventaja para el deudor el verse sometido a un proceso en el cual, adicional a la obligación que debe cumplir, se sumen gastos de honorarios causados por acudir a éste mecanismo alternativo de solución de conflictos, apreciación que difiere al hecho de que si los árbitros administran justicia y dentro de los procesos declarativos les es permitido decretar medidas cautelares, están haciendo uso del poder de coerción apuntando a que la decisión que profieran tenga efectividad, en cierto sentido, ven (al igual que los jueces de la jurisdicción ordinaria), en las medidas cautelares la garantía de que sus decisiones sean cumplidas. Finalmente, es claro que la naturaleza de las medidas cautelares se basa en la sorpresa de su trámite, de manera que a quien se le decrete una medida, no tenga el tiempo ni la oportunidad de llevar a cabo actuaciones tendientes al no cumplimiento de estas, tanto así que lo usual es que primero se decretan y tramitan las medidas cautelares y después se notifica al demandado, presupuesto que no es viable en el proceso arbitral, dado a la novedad de sus etapas y la duda respecto al momento en que se debe decretar las medidas; cabe entonces preguntarse si las medidas cautelares dentro del proceso arbitral cumplen de manera eficaz su función.

With the issuance of the Statute of National and International Arbitration it is allowed that within the process, all the precautionary measures that, depending on the case being studied, would be adequate to safeguard the rights of the party that is being investigated, are decreed (upon request of the interested party). raises the petition, citing what the law called unnamed precautionary measures; argument that is analogous to any process that is ahead in the ordinary jurisdiction and / or administrative litigation, the novel thing is that the arbitrator only has jurisdiction for a certain time, they are transitory judges, that is, it is ad hoc for the specific case, foundation that makes the great difference in terms of individuals administering justice, to such an extent that only allow arbitration to vent issues of free disposal and those authorized by law, the legislator being reluctant to prohibit the advancement by the arbitration of executive processes, arguing that it would be a disadvantage for the debtor to be subject to an arbitration process, an assessment that differs from the fact that if the arbitrators administer justice and within declaratory processes they are allowed to order precautionary measures, they are making use of the power of coercion, pointing to the fact that the decision they make is effective, in a certain sense, they see (like the judges of the ordinary jurisdiction and / or administrative litigation), in the precautionary measures the guarantee that their decisions are fulfilled. Finally, it is clear that the nature of the precautionary measures is based on the surprise of their procedure, so that whoever is ordered a provisional measure does not have the time or the opportunity to carry out actions tending to non-compliance with the measures , so much so that the usual thing is that first the precautionary measures are decreed and processed and then the defendant is notified, a budget that is not viable in the arbitration process, given the novelty of its stages and the doubt as to when it should be decree the measures; It is therefore necessary to ask whether the precautionary measures within the arbitration process effectively fulfill their function.
