Abstract
La confesión por apoderado judicial es una figura contemplada como una de las
modalidades de este medio probatorio, consagrada en el código General del Proceso Ley 1564 de
2012, en su Artículo 193, norma en la cual se señala en que eventos tiene validez esta modalidad
de confesión, en contraste con el Articulo 197 del derogado Código de Procedimiento Civil, que
no hacia explicita esas facultades respecto al apoderado para confesar. En concordancia con lo
señalado, en el presente trabajo se estudiara y analizara el alcance que tiene la confesión por
apoderado judicial en los procesos civiles.
Por otra parte, de manera más específica el presente trabajo se ubicara en el evento concreto
que tiene relación con la hipótesis concerniente a la no procedencia de que el apoderado judicial
absuelva el interrogatorio de parte dentro de un proceso civil. Lo anterior bajo la tesis que se
defiende consistente en que bajo la relación fuente de prueba- medio de prueba, es la parte la que
debe comparecer al proceso para absolver el interrogatorio de parte.
The testimony by judicial attorney is a figure considered as one of the modalities of this
evidentiary means, enshrined in the General Code of the Process Law 1564 of 2012, in its Article
193, rule in which it is indicated in which events is valid this modality of testimony, in contrast to
the Article 197 of the repealed Civil Procedure Code, which did not make explicit these faculties
in respect to the attorney in order to testify.
According to the aforementioned, in this work the scope of the testimony by a legal
representative in civil procedures will be studied and analyzed. On the other hand, in an specific
way, this work will be located in the particular event that is related to the hypothesis regarding the
non-provenance of the judicial attorney acquitting the interrogation of party in a civil process. The
foregoing, under the thesis that is defended, consists in the fact that under the relation source of
evidence-means of evidence, it is the parth that must appear in the process to acquit the
interrogation of the parth.
