Abstract
La indemnización integral como figura jurídica procesal para dar por terminado un proceso penal, al ser estudiada, evidencia una laguna en la regulación normativa respecto al procedimiento penal ordinario actual (Ley 906), teniendo que acudirse a normas procesales anteriores, como lo es la Ley 600 de 2000. Ahora, en el Proceso Penal Militar en su parte procedimental se encuentra ausente esta regulación, lo que limita el consenso entre el sujeto activo y el sujeto pasivo o la víctima, para poder resarcir el daño ocasionado con la conducta punible, respecto de los tipos penales comunes descritos en el Código Penal Colombiano que admiten esta forma de terminación y que son investigados por la jurisdicción especial militar, ya que no aplica en los delitos especiales militares, por su naturaleza. Es por ello, que, si se diera la aplicación de esta causal de terminación, se lograría la extinción de la acción penal militar, permitiendo que la administración de justicia castrense fuese más eficaz y efectiva, siempre respetando los principios procesales y constitucionales. Siendo necesario hacer un análisis normativo en este trabajo, para mirar la forma en la que esta figura podría ser integrada al Proceso Penal Militar, teniendo en cuenta la concepción doctrinal que describieron los autores Antonio González, Hans Joachim Hirsch y Claus Roxin, así como la aplicación del estudio analógico implementado en la investigación documental de textos jurídicos, jurisprudenciales -nacionales e internacionales- y legales que sirvieron como fundamento para la respuesta al cuestionamiento de investigación.
Comprehensive compensation as a procedural legal figure to terminate a criminal process, when studied, shows a gap in the normative regulation regarding the current ordinary criminal procedure (Law 906), having to resort to previous procedural rules, such as the Law 600 of 2000. Now, in the Military Criminal Process in its procedural part, this regulation is absent, which limits the consensus between the active subject and the passive subject or the victim, in order to compensate the damage caused by the punishable conduct, regarding of the common criminal types described in the Colombian Penal Code that admit this form of termination and that are investigated by the special military jurisdiction, since it does not apply to special military crimes, due to their nature. That is why, if this termination cause were applied, the extinction of military criminal action would be achieved, allowing the military justice administration to be more efficient and effective, always respecting procedural and constitutional principles. Being necessary to make a normative analysis in this work, to look at the way in which this figure could be integrated into the Military Criminal Process, taking into account the doctrinal conception described by the authors Antonio González, Hans Joachim Hirsch and Claus Roxin, as well as the application of the analog study implemented in the documentary research of legal, jurisprudential -national and international- and legal texts that served as the basis for the answer to the research questioning.
