Abstract
Con la expedición de la Ley 1934 de agosto 2 de 2018, se han realizado cambios al régimen de las herencias en Colombia. A partir del 1º de enero de 2019 se debe adjudicar el 50% de los bienes a quien se desee (libertad testamentaria), con lo cual, se amplía la opción de obtener libremente por parte del testador, que hasta esa fecha era solo el 25%, y la cual se conoció como “cuarta de libre disposición”. La libertad de testar existe en diferentes legislaciones, desde la antigüedad romana, cuando la persona podía entregar sus bienes con total autonomía, antes de su muerte. Sin embargo, las injusticias cometidas con niños menores de edad que quedaron en un estado de vulnerabilidad protegieron el sistema de asignaciones forzadas, que pasó al Código Napoleónico y, posteriormente, a nuestra legislación. Por lo tanto, hay quienes advierten que, en la legislación colombiana, tal iniciativa sería peligrosa, ya que conduciría a la falta de protección de las personas especialmente vulnerables, como los niños con limitaciones físicas o mentales que no son capaces de subsistir por sí mismos o quienes se encuentran en situación de pobreza. Además, afirman que permitir una reforma de este tipo llevaría a los padres a abandonar a sus familiares y dejar su propiedad a terceros, que no tienen un derecho legítimo. De la misma manera, en relación de la Ley 1893 de mayo 24 de 2018, en vigencia desde esa misma fecha. También se modificó el artículo 1025 del Código Civil, en relación de indignidades para suceder, añadiendo nuevas causales, tales como: “el abandono sin justa causa” de la persona a quien se pretende heredar, el procesado por los delitos de: “violencia intrafamiliar”, “maltrato por descuido” o “abandono de persona mayor de 60 años”.
El testador no tiene libertad real para decidir sobre la desheredación. Nuestro Código Civil reemplaza la libertad de disponer de activos después de la muerte, por una medida arbitraria que consiste en dividir por la fuerza los activos entre los legitimados, es una medida paternalista que se incrustó en nuestras costumbres, como si fuera una fatalidad. En última instancia, la desheredación depende de un tercero, un juez, y no del propietario del patrimonio, como debería ser. Con relación a la muerte de uno de los cónyuges, el cónyuge sobreviviente puede decidir recibir propiedades, ya sea como cónyuge con derecho a la propiedad comunitaria, o como un heredero con derecho a una cierta parte del patrimonio completo.
With the issuance of Law 1934 of August 2, 2018, changes have been made to the inheritance regime in Colombia. As of January 1, 2019, 50% of the assets must be awarded to whoever is desired (testamentary freedom), thereby expanding the option of obtaining freely by the testator, which until that date was only 25 %, and which became known as the “freely available fourth”.
The freedom to testify exists in different laws, since Roman antiquity, when the person could hand over their assets with total autonomy, before their death. However, the injustices committed with underage children who were left in a state of vulnerability protected the system of forced assignments, which passed to the Napoleonic Code and, later, to our legislation. Therefore, there are those who warn that, in Colombian legislation, such an initiative would be dangerous, since it would lead to the lack of protection of especially vulnerable people, such as children with physical or mental limitations who are not able to survive on their own or those who are in a situation of poverty. In addition, they affirm that allowing such a reform would lead parents to abandon their relatives and leave their property to third parties, who do not have a legitimate right. In the same way, in relation to Law 1893 of May 24, 2018, in force from that same date. Article 1025 of the Civil Code was also modified, in relation to indignities to happen, adding new grounds, such as: “the abandonment without just cause” of the person to whom it is intended to inherit, the person prosecuted for the crimes of: “intrafamily violence ”,“ Neglect abuse ”or“ abandonment of a person over 60 years old ”.
The testator has no real freedom to decide on disinheritance. Our Civil Code replaces the freedom to dispose of assets after death, by an arbitrary measure that consists of forcibly dividing the assets among the legitimate ones, it is a paternalistic measure that is embedded in our customs, as if it were fatality. Ultimately, disinheritance depends on a third party, a judge, and not on the owner of the estate, as it should be. In relation to the death of one of the spouses, the surviving spouse may decide to receive property, either as a spouse entitled to community property, or as an heir entitled to a certain part of the entire estate.
