Abstract
Los derechos políticos son una garantía fundamental en la Convención Americana sobre Derechos Humanos, sin embargo, algunos estudios afirman que Colombia es uno de los pocos Estados en el cual restringe dicho derecho a los miembros de su Fuerza Pública. Por lo cual, la presente tesis busca dar respuesta a la pregunta ¿Cuáles son los estándares convencionales de los derechos políticos que permiten la restricción del derecho a elegir a los integrantes de la Fuerza Pública colombiana? Para dar respuesta a la pregunta problema se hizo aplicación de un sistema semiautomático de búsqueda de jurisprudencia de la Corte Interamericana en el marco de la inteligencia artificial aplicada al método de análisis jurisprudencial, investigación interdisciplinaria entre el Grupo de Derecho Público y el Grupo ACCEDER de Ingeniería Multimedia, ambos de la Universidad Militar Nueva Granada. Teniendo como resultado que el Estado colombiano cumple con sus obligaciones internacionales y está facultado a limitar el derecho al voto de los miembros de la Fuerza Pública debido a que los derechos políticos no son absolutos y la limitación establecida por el Estado de Colombia en el artículo 219 de su Constitución Política es legítima, necesaria y proporcional. Este resultado se allega después de haber hecho aplicación de la herramienta informática la cual identifica los espacios citacionales que permiten establecer los espacios convencionales de los derechos políticos en la jurisprudencia de la Corte Interamericana.
Political rights are a fundamental guarantee in the American Convention on Human Rights; however, some studies affirm that Colombia is one of the few States in which it restricts said right to the members of its Public Force. Therefore, this thesis seeks to answer the question: What are the conventional standards of political rights that allow the restriction of the right to elect the members of the Colombian Public Force? To answer the problem question, a semi-automatic system of search for jurisprudence of the Inter-American Court was applied in the framework of artificial intelligence applied to the jurisprudential analysis method, interdisciplinary research between the Public Law Group and the ACCEDER Engineering Group Multimedia, both from the Military University Nueva Granada. Having as a result that the Colombian State fulfills its international obligations and is empowered to limit the right to vote of the members of the Public Force because the political rights are not absolute and the limitation established by the State of Colombia in Article 219 of its Political Constitution is legitimate, necessary and proportional. This result is close after having made application of the computer tool which identifies the citation spaces that allow establishing the conventional spaces of political rights in the jurisprudence of the Inter-American Court.
